Introduction
The National Privacy Principles established by the Privacy Act 1988 apply to Conari Partners. This statement sets out Conari Partners’ policy relating to the collection and use of personal information.
Conari Partners recognises that your personal information is very important to you and that you have a right to control this. We know that providing personal information is an act of trust and we take that seriously. The following policy will govern how Conari Partners handles your personal information and safeguards your privacy.
The National Privacy Principles require that we have a clear and concise statement of the key features of our privacy policy that we can produce upon request.
Conari Partners is an executive recruitment organisation and, as part of our functions, we collect personal information either indirectly or directly via lawful and fair means. Conari Partners will always ensure we have your consent (either verbal or written) before we begin any collection process in connection with our recruitment activities.
Personal information that we collect and hold usually falls into the following categories :
· Candidate Information submitted and obtained from the Candidate and other sources in connection with applications for work;
· Work performance information;
· Staff information;
· Information obtained to assist in managing client and business relationships.
We primarily hold personal information for the following :
· Executive placement operations;
· Client and business relationship management.
Collecting Personal Information About You
As part of our primary function, Conari Partners are required to directly and indirectly collect personal information about individual candidates. As regards collecting personal information via an indirect means (ie. through referees or publicly available industry sources such as journals, magazine articles etc.), Conari Partners ensures that the candidate is aware that we are collecting this information on their behalf and has consented to this collection.
As part of our collection process, candidates will be supplied with a Collection Statement which they will be requested to sign and return to Conari Partners. If individuals fail to sign and return our Collection Statement but have requested Conari Partners to endeavour to find work placements for them, we will deem that they have consented to our collecting, using and disclosing personal and sensitive information about them as indicated in our Collection Statement.
Conari Partners ensures that all personal information we collect is kept in a secure area. We only send personal information to nominated prospective employers and always ensure that the candidate is aware we are sending out their personal information. We also ensure that candidate's personal information is kept in a single file which is available should they wish to re-confirm or update their details.
Subject to some exceptions that are set out in the National Privacy Principles, you can gain access to the personal information we hold about you.
We do refuse access if it would interfere with the privacy rights of other persons or if it breaches any confidentiality that attaches to that information.
If you wish to obtain access to your personal information you should contact our privacy officer. You will need to be in a position to verify your identity. We might impose a moderate charge in providing access. Our privacy officer would discuss this with you.
You should also anticipate that it may take a little time to process your application for access as there may be a need to retrieve information from storage and review information in order to determine what information may be provided.
Using & Disclosing your Personal Information
We do not disclose personal information to nominated clients unless we have the candidate’s express permission to do so. In each instance, the candidate is aware of the nominated client (corporation, individual or legal entity) to whom their information is being sent. We also ensure personal information is correct and up to date before being passed to any nominated client organisation (corporation, individual or legal entity).
In some cases, we may only disclose information with your consent.
We may also disclose your personal information where we are under a legal duty to do so, including circumstances where we are under a lawful duty of care to disclose information.
We contract out a number of services from time to time. Our contractors may see some of your personal information. Typically, our contractors would be only IT contractors and database designers.
Conari Partners has several partnerships with foreign companies and/or clients and/or legal entities. We occasionally have a requirement to send personal information about candidates to these foreign companies/ clients/ legal entities in response to specific executive recruitment search requests.
In each case, Conari Partners ensures that we have the candidate’s specific consent to this transfer. We ensure that personal information being sent to a foreign company/ client/ legal entity is correct and up to date at the time of sending. We also obtain confirmation from the foreign company/ client/ legal entity that they will not forward a candidate’s personal information to third parties without the candidate’s express consent.
